Terms of Service
These terms are the agreement between you and RUBYNESS LTD about your use of Perunika. Please read the beta and health sections — they matter more than the rest.
Perunika is beta software. It is not a finished product. Features change without notice, things break, and in the course of the beta your account data may be reset or lost. Do not rely on Perunika as the only record of anything you care about.
1. Accepting these terms
By installing or using Perunika, you agree to these terms. If you do not agree, do not use the app. If you are using Perunika on behalf of an organisation, you confirm you are authorised to accept these terms for it.
Perunika is distributed through Apple TestFlight during the beta. Apple's own terms also apply to your use of TestFlight, and Apple is not a party to this agreement.
2. Beta software
Perunika is offered as a pre-release beta, free of charge. That has real consequences you should plan around:
- Features may be added, changed or removed at any time without notice.
- The app may contain bugs, may crash, and may show wrong data.
- Your data may be reset, migrated or deleted as we change how the service works.
- Access may end at any time, including at the end of the beta programme.
- TestFlight builds expire and stop opening. Keeping the app working requires installing updates.
We would rather you knew this up front than discovered it. Feedback about any of it is welcome and is the reason the beta exists.
3. Health, fitness and your safety
Perunika is not a medical device and does not give medical advice. Nothing in the app — challenges, targets, streaks, readings, prompts or anything another user posts — is a diagnosis, a treatment recommendation, or a substitute for professional medical judgement.
Perunika reads activity and health information from Apple Health and presents it back to you. Those figures are estimates produced by your device and the apps that wrote them. They can be inaccurate. Do not use them to make medical decisions.
Physical activity carries risk, and some activities the app can track — including cold exposure and intense or prolonged exercise — carry risk of serious injury or death, particularly for people with underlying cardiac, respiratory, circulatory or neurological conditions, and for anyone who is pregnant. Cold water immersion in particular can trigger involuntary gasping, cardiac events and loss of consciousness, and should never be done alone.
You take part at your own risk. Talk to a doctor before starting or significantly changing a fitness routine. Stop immediately if you feel unwell. Never treat a challenge, a group target, a streak, or encouragement from other users as a reason to continue past what is safe for you. You are solely responsible for judging what your body can do.
4. Who can use Perunika
You must be at least 16 years old to use Perunika. The app handles health information and includes social features, and it is not designed or intended for children. If we learn that someone below the minimum age has created an account, we will delete it.
5. Your account
Accounts are created with Sign in with Apple. You are responsible for what happens under your account and for keeping access to your Apple ID secure. Tell us promptly if you believe your account has been used without your permission.
You may delete your account and the data associated with it at any time. How to do that, and what happens to your data afterwards, is described in the Privacy Policy.
6. Your content
Anything you put into Perunika — activities, photos, videos, comments, names, group content — remains yours. We do not claim ownership of it.
To run the service we need permission to handle it: you grant us a worldwide, non-exclusive, royalty-free licence to store, reproduce, adapt and display your content, solely for the purpose of operating and improving Perunika and showing your content to the people you have chosen to share it with. This licence ends when you delete the content or your account, except where we are required to keep something by law and except for copies already shared with other users.
You confirm you have the right to share what you upload, including the right to share images or video of anyone appearing in it.
7. Acceptable use
Do not use Perunika to:
- Harass, threaten, bully or impersonate anyone.
- Upload content that is illegal, hateful, sexually explicit, or depicts real violence.
- Upload someone else's personal information, or content you have no right to share.
- Falsify activity data, or manipulate challenges, rewards or leaderboards.
- Scrape, reverse engineer, probe or attack the service or the accounts of other users.
- Resell or redistribute access to the beta, or share builds outside TestFlight.
8. Availability and changes
We do not promise the service will be available, uninterrupted or error-free. We may modify, suspend or discontinue any part of Perunika at any time.
We may update these terms. If a change is significant we will make a reasonable effort to tell you before it takes effect — in the app, by email, or on this page. Continuing to use Perunika after a change means you accept the updated terms.
9. Ending your use
You can stop using Perunika and delete your account at any time. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if we end the beta programme. Sections that by their nature should survive termination — content licences already granted to other users, disclaimers, limitation of liability, and governing law — continue to apply.
10. Disclaimers and liability
Perunika is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
To the fullest extent permitted by law, RUBYNESS LTD will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use Perunika. Our total liability for any claim relating to Perunika will not exceed the greater of the amount you paid us in the twelve months before the claim (which, during the free beta, is nothing) or £100.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, you keep any rights the law of your country gives you that cannot be waived by agreement.
11. Governing law
These terms are governed by the laws of Scotland, and the Scottish courts have exclusive jurisdiction over any dispute, except that if you are a consumer you may also bring proceedings in the country where you live, and the mandatory consumer protection law of that country continues to apply to you.
